Am Mittag des 19. Juni 2013 wurde um 12:08 Uhr auf golem.de der Artikel „Downloadfunktion für Streaming in Deutschland verboten“ veröffentlicht, der um 13:35 Uhr noch um einen Nachtrag ergänzt worden ist. Die Nachricht wurde darauf hin, leicht abgeändert, von einigen weiteren Portalen übernommen. Dieser Artikel gibt die Reich- und Tragweite der einstweiligen Verfügung des LG Hamburg vom 25. April 2013 (Az.: 310 O 144/13) aber nur teilweise zutreffend wieder. Gerne stellen wir noch einmal unsere Sicht auf die Sach- und Rechtslage dar:

1. Die Überschrift des Artikels, „Downloadfunktion für Streaming in Deutschland verboten“, ist insoweit missverständlich, als dass das LG Hamburg das Herunterladen von gestreamten Inhalten nicht generell verboten hat, sondern lediglich den Download von im RTMPE-Verfahren geschützten Streams.
2. Die offizielle Version der Software, also der JDownloader, hat zu keinem Zeitpunkt den Download solcher Streams ermöglicht.
3. Die Funktion war lediglich vorübergehend in einer Beta-Version der Software, also den Nightly-Builds des JDownloader2, enthalten. Diese Nightly-Builds werden von uns automatisch alle 5 Minuten auf Grundlage der jüngsten Änderungen durch die OpenSource-Community erstellt. Ein Entwickler aus dieser Community hatte die Funktion eingebaut.
4. Auf entsprechenden Hinweis ist diese Änderung selbstverständlich rückgängig gemacht worden. Sowohl der JDownloader als auch die aktuellen Nightly-Builds (JDownloader2) sind also weiterhin legal.
5. Der Geschäftsführer von AppWork hat gegen die einstweilige Verfügung inzwischen Rechtsmittel eingelegt, weil es um weit mehr geht als die Rechtmäßigkeit einer Software zum Download von RTMPE-geschützten Streams. Das Verfahren betrifft nämlich ebenso die grundsätzliche Frage, wer in welchem Umfang für OpenSource-Software haftet. Muss der Betreiber einer OpenSource-Plattform tatsächlich jede noch so kleine Änderung, die die Community vornimmt, vorab auf ihre Rechtmäßigkeit prüfen? Unter anderem über diese Frage wird das Landgericht Hamburg nunmehr zu entscheiden haben. Der Verhandlungstermin ist für den 12. September 2013 angesetzt.
